MaDiSt General Terms & Conditions

Preamble
These General Terms and Conditions (“General T&Cs” or “T&Cs” or Agreement”) govern the
contractual relationship between the parties: MaDiSt Ltd, hereinafter referred to as "MaDiSt" or “Us”
and you, the user, hereinafter referred to as "CLIENT," "You," or "Player."
Definitions
The following words and terms shall be understood as defined below:
"MaDiSt Ltd" is the entity that operates any related products and service that refers or link
to these legal terms.
"Registration Form" means the form completed by the Player to open a User Account.
"Game" refers to any gaming activity provided by MaDiSt on its App for the benefit of
Players.
Application” or APP” means the MaDiSt app, which can be freely downloaded on iOS and
Android devices through their respective distribution platforms, such as the App Store and Google
Play.
"Login and Password" means the login and password credentials selected by a Player
during the online registration process.
"Service" (or “Services”) encompasses all services and gaming activities listed
on www.madist.co.uk.
"Software" refers to the licensed software, including all programs, databases, and
any other derived content, whether accessible or otherwise used by You through the MaDiSt
APP, which enables Your participation in our game.
"Us, We, or MaDiSt" refers to MaDiSt Ltd.
"User Account," "Player Account," "Game Account," or simply "Account" means a
personal account opened by an individual and maintained by MaDiSt, which allows the
individual to participate in our online game.
"You, CLIENT, Player, or User" refers to the user of the Service and the software
accessible through the APP, who has a contractual relationship with MaDiSt.
"Premium Players" refers to individuals aged 18 or over who participate in games
involving real money. Depending on the type of game selected, Players may also participate
as "Free Players" without spending real money.
1. Agreement to our Legal Terms
1. The operator of this APP is MaDiSt Ltd, the registered address is: 71-75 Shelton Street,
Covent Garden, London, United Kingdom, WC2H 9JQ.
2. MaDiSt General T&Cs constitute a legally binding agreement made between you and MaDiSt
Ltd concerning your access to and use of the Service.
3. This Agreement describes the terms, conditions, and risks applicable to the CLIENT's use of
MaDiSt Ltd services, available under the domain of www.madist.co.uk. If the CLIENT has any
questions regarding this Agreement, they can contact Us at info@madist.com.
4. The term "CLIENT" or “PLAYER” refers to any individual or entity that explicitly or
implicitly agrees to MaDiSt General T&Cs by opening an account and participating in one or
more games on the APP.
5. All CLIENTS accessing the MaDiSt APP agree to adhere to the following T&Cs
governing the use of its services (the "Agreement"). If you do not agree with all of these legal
terms, then you are expressly prohibited from using the services and you must discontinue
use immediately.
6. The CLIENT must read, agree with, and accept all of the terms and conditions
contained in this Agreement without modification before they become an active and
registered CLIENT of MaDiSt.
7. Supplemental terms and conditions or documents that may be posted on the
Services from time to time are hereby expressly incorporated herein reference.
8. MaDiSt reserves the right, in our sole discretion, at any time and for any reason to
make changes or amends to these General T&Cs.
9. MaDiSt will alert the PLAYER about any changes by updating the “Last updated” date
of these General T&Cs; any change applied shall take effect as of the day it was published on
the APP.
10. In the case of a modification of these General T&Cs, upon logging into their account
the PLAYER will be informed by a pop-up box that MaDiSt General T&Cs have been updated.
The PLAYER will be asked to agree to the updated General T&Cs.
11. The PLAYER will be subject to, and will be deemed to have been made aware of and
to have accepted, the changes in any revised MaDiSt Legal Terms by their continued use or
access to the APP or the Software offered by MaDiSt.
12. It is the CLIENT responsibility to check whether this Agreement has been changed; if
the CLIENT does not agree with the General T&Cs anymore or doesn’t want to accept any
amendment, for whatever reason, they must discontinue use or access and must inform Us
immediately.
13. This Agreement takes effect upon acceptance during the registration process when newly
registering CLIENTS check the box stating "I have read, understood and accepted MaDiSt General Terms
& Conditions" and click the "Create new account" button during the registration process
on www.madist.co.uk. The CLIENT commits to complying with MaDiSt General T&Cs of the APP.
14. MaDiSt will not be liable in any way to any persons in the event of force majeure or
for the act of any government or legal authority. If any provision of this Agreement is held to
be invalid or unenforceable, the remaining provisions will remain in full force and effect.
15. Failure by a party to enforce any right or provision of this Agreement will not be
deemed a waiver of such right or provision.
16. MaDiSt has no responsibility, nor does it have any control, in the event of postponed
and/or suspended matches. Should one or more of the above-mentioned events occur, the
rules of the general season will be followed.
17. MaDiSt General T&Cs, and any dispute or claim (whether it may be or not be a
contractual dispute or claim) shall be governed by and defined following the laws of England
and Wales.
18. In case of an issue or a dispute, CLIENTS are firmly encouraged to first contact MaDiSt
Ltd through our customer support. Both entities aim to resolve any issue or dispute amicably
and in a timely manner. Any dispute arising between the CLIENT and MaDiSt Ltd that cannot
be resolved through MaDiSt Ltd’s internal complaints procedure shall be referred to the
Centre for Effective Dispute Resolution (CEDR). If the dispute remains unresolved after CEDR,
the parties agree that the courts of England and Wales shall have exclusive jurisdiction over
any dispute or claim arising from or related to this Agreement.
19. There may be information on the APP or the Services that contains typographical
errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various
other information. MaDiSt reserves the right to correct any errors, inaccuracies, or omissions
and to change or update the information at any time, without prior notice.
20. In the event of any discrepancy between the English language version of this
Agreement and any translated version, the English language version shall prevail for
purposes of interpretation and dispute resolution.
2. Online Services Agreement
1. This Agreement is made by and between MaDiSt and the CLIENT. This Agreement applies to
the MaDiSt APP including its electronic content and software currently available on the APP, which
provides the CLIENT with the games and services offered by MaDiSt.
2. MaDiSt reserves the right to impose certain conditions (beyond those detailed in
sections 3, 4, 5, 6, 7 & 8) on the admission of Players to some of the games. Such conditions
may include, but are not limited to, a minimum number of completed games, age verification
for “Premium Players” and the verification of payment transactions. MaDiSt also reserves the
right to extend or change the services available on the APP at any time.
3. The maximum amount that can be paid to participate in any of the games offered
on the APP is determined by MaDiSt specifically for each event. These limits are subject to
change without prior written notice.
4. The decisions referred to at section 2 paragraph 3 will be taken and disclosed at least
24 hours before a game will be playable and once they have been disclosed, they will not
change.
5. Players can access their transaction history, including deposits and payment details,
at any time. A minimum of 3 months’ history is available, with up to 12 months provided
upon request. Current account balance is displayed on the interface.
6. The information provided when using one or more of the Services is not intended
for distribution to or use by any person or entity in any jurisdiction or country where such
distribution or use would be contrary to law or regulation or which would subject us to any
registration requirement within such jurisdiction or country.
7. Moreover, the possibility to access the MaDiSt APP does not automatically grant that
the Services and/or CLIENT activities through it are legal under the laws, regulations, or
directives applicable to the CLIENT's country of domicile.
8. In this specific regard, the CLIENT specifically understands and accepts that MaDiSt
is unable to provide legal advice or assurances regarding the legality of using its Services in
any specific jurisdiction.
9. Regarding section 2 paragraphs 6 8, if one or more PLAYERS choose to access our
Services and/or play any related game from other locations do so on their own initiative and
are solely responsible for compliance with local laws, if and to the extent local laws are
applicable. Participation in the games is at the PLAYER's sole option, discretion, and risk. By
playing the games, the PLAYER acknowledges that they do not find the games or services to
be offensive, objectionable, unfair, or indecent in any way.
3. Premium Players & Free Players
1. The Services are available to, and may only be used by, the following categories of individuals:
People aged 18 or older these individuals are the only qualified to be “Premium Players”
and therefore consequently can participate in paid games, tournaments and leagues
(“Premium Games”).
Emancipated minors these individuals only qualify to play as “Free Players” and
therefore cannot access Premium Games.
Minors that have valid parent or legal guardian consent to be bound by these Legal Terms
- these individuals only qualify to play as “Free Players” and therefore cannot access
Premium Games.
2. The Premium Games are strictly unavailable to persons under the age of 18. If the
CLIENT is a Minor, they are prohibited from using these kinds of services. If you do not meet
the eligibility criteria, please do not use our APP. Participation in Premium Games is
exclusively reserved for individuals aged 18 or older.
3. Upon entering Premium Games, MaDiSt will require the PLAYER to provide proof of
age and will refuse admission to the games or the tournaments if there are reasonable
grounds to believe that the minimum age requirement is not met.
4. By entering the Premium Games, the CLIENT represent and warrant that: 1) they
have the legal capacity and agree to comply with these Legal Terms; 2) they are not under
the age of 18; 3) that it will never engage in any of the conduct indicated as prohibited in
sections 5 and 16 below.
5. By entering the Free Games, the CLIENT represent and warrant that: 1) they are at
least emancipated minors or are minors that obtained valid parent or legal guardian consent
to be bound by MaDiSt Legal Terms; 2) that it will never engage in any of the conduct
indicated as prohibited in sections 5 and 16 below.
6. If you’re not an adult or emancipated minor, or don’t understand this Section, please talk
to your parents or legal guardian and ask for help.
7. As the parent or legal guardian of a minor who creates an account with us, you and
the minor accept and agree to be bound by MaDiSt General T&Cs. The parent or legal
guardian is also responsible for all use of the account and compliance with this Agreement
by the minor.
8. In all circumstances, MaDiSt will not be held liable for any misuse of its services by
unauthorized parties or Minors.
9. The only way to gain access to Premium Games is to prove one's age of majority;
therefore, if a Free Player has become an adult, or simply wants to participate in Premium
Games being already 18 or older, they must provide proof thereof.
4. Registration Information & Premium Upgrade
1. Before participating in any of MaDiSt games as a PLAYER, the USER must first complete the
registration form on the APP and to participate in games as a Player, the User must complete the
registration form on the APP and thereby open a "Player Account."
2. The registration and setup of a Player Account are free of charge. So is participating in any
game, tournament or league, unless the PLAYER switches to a Premium Account.
3. Any Player Account is initially only a Free Player Account; during the registration process, the
User must provide the following details when filling out the registration form provided by MaDiSt:
a) Valid Email Address: The CLIENT must provide a valid email address. The email address used for
registration will also serve as a valid username for access to MaDiSt Services.
b) Password: The CLIENT must choose a strong, non-predictable password for security purposes and
is responsible for ensuring that the password is kept confidential.
c) Team Name ("Teamname"): The PLAYER must choose a unique, clearly identifiable Team Name.
The teamname will be shown to other players and it will serve as the Players tag name in any game,
tournament, league or event. PLAYERS must remember, at all times, that the use of offensive,
indecent, inappropriate or discriminatory teamnames as well as names that allude to Internet
connections or that may imply certain rights (e.g. the term ‘Administrator’ or ‘Moderator’ is reserved
for MaDiSt) is strictly prohibited. MaDiSt reserves the right to suspend any account that violates this
guideline, with the understanding that such accounts may be reactivated when a compliant team
name is chosen.
4. The CLIENT is not allowed to register if they already have an active account with
MaDiSt. Each person may only have one account. See Section 5 paragraph 3, lett. b)
(Prohibited Activities, Behaviours or Misconducts) for more information.
5. The CLIENT is responsible for securing their Username and Password for their
account with MaDiSt and is also responsible for ensuring that this password remains
confidential. MaDiSt will not be held liable for any damages caused due to the CLIENT's
inappropriate or irregular use of their Account or Log-In information.
6. If an eligible CLIENT wishes to participate in Premium Games, MaDiSt will request the
following information upon registering a Premium Account:
a) Customer's Identity: The CLIENT warrants that all information provided regarding identity during
the registration process is true, accurate, current, and complete. The CLIENT must register
personally and not on behalf of someone else. During the registration process, the CLIENT will be
required to provide valid identity verification and relevant documentation.
b) Date of Birth: The CLIENT must provide their date of birth. In the event that the CLIENT wants to
participate in the Premium Games, they must confirm that they are 18 years of age or older. The
Premium Player will be required to present proof of identity; MaDiSt will conduct a verification
process to ensure the Premium Player's Age and details are correct. During the upgrade process,
the CLIENT must provide valid identification.
c) Place of Residence: CLIENTS must be able to provide that they reside in UK and give a valid home
address.
7. The CLIENT is responsible for keeping registration details up to date and must make
necessary changes to their name, or email address on MaDiSt’s APP without undue delay. It
is the PLAYER’s sole responsibility to inform MaDiSt immediately of any changes to personal
information.
8. If MaDiSt has reason to believe that the information provided is inaccurate, MaDiSt
reserves the right to suspend or terminate the Users Account and retain any prizes or void
any bonuses previously awarded.
9. If the PLAYER suspects that their security details are no longer confidential, they must
notify MaDiSt immediately. Upon notification, MaDiSt will issue new security details, and any
future transactions made under the compromised details will be considered void.
10. Unless PLAYERS notify that their access or security data are no longer confidential,
MaDiSt will consider any gaming activity conducted on the APP under the PLAYER's
Username, Teamname and security details valid, regardless of who participates in the game.
11. MaDiSt will not be held responsible for unauthorized access to a User Account by a
third party and accepts no liability for any loss suffered due to the illicit use of a PLAYER's
password or unauthorized access to their account. MaDiSt is also not responsible for any
transaction made under the PLAYER's registered Username and password, as long as those
credentials were entered correctly.
12. MaDiSt will treat the CLIENT's information with care, in accordance with the
disclosures made during the registration and/or upgrade processes and as outlined in the
Privacy Policy.
13. The CLIENT's registration may be refused or closed at MaDiSt's sole discretion, but
any contractual obligations already established will be honored.
14. There is no general right to registration or participation in the games, tournaments
or leagues.
15. All documentation provided for KYC (Know Your Customer) or other purposes must
be submitted in Latin script (languages using the classical Latin alphabet). For documents in
other writing systems, an official transliteration into the Latin alphabet or an official
translation into English must be provided.
16. MaDiSt reserves the right, at its sole discretion, to require a CLIENT to provide
additional proof of identity (KYC documentation), such as a notarized copy of a passport or
other means of verification, as deemed necessary. MaDiSt may, at its discretion, suspend the
account until such proof is provided to its satisfaction.
5. Prohibited Activities & Misconducts
1. The PLAYER may not access or use the Services for any purpose other than that for which it
is made available. The Services may not be used, in any case, in connection with any
commercial endeavors.
2. No person under 18 years of age can be registered as a Premium Player, and all credit
deposited, as well as any prizes won or bonuses achieved will be canceled or confiscated. In
this eventuality, MaDiSt will proceed to report all relevant circumstances to the competent
authorities.
3. A CLIENT's behavior will be considered a violation of MaDiSt General Terms & Conditions and
classified as a prohibited activity if, but not exclusively when the CLIENT engages in one or
more of the conducts listed in this following paragraph. As a USER of the Services, the PLAYER
agrees not to:
a provide in any part of the interaction with MaDiSt any false information (including their
age), impersonation or misrepresentation regarding affiliation with any person, entity or
association, or any use of false headers or other means to conceal one's identity from MaDiSt,
will be prosecuted to the fullest extent of the law.
b implement so-called multi-accounting. In this sense, the creation, management and/or use
of multiple MaDiSt accounts is strictly prohibited. MaDiSt reserves the right to delete and/or
cancel any User Account and cancel or void all transactions related to any PLAYER found to
have registered multiple Accounts under their own name or different names, especially if
this was done with the intent of defrauding or cheating.
c transfer, sell, or acquire credits and funds to other players.
d make any deposit originated from or target any illegal or unauthorized activities, such as
money laundering or terrorism financing.
e manipulate (or attempt to) the outcome of games, tournaments and/or leagues through
concerted practices, software alterations, or any other undue methods.
f deliberately causes malfunctions or defects on the APP to disrupt the natural flow of any
game tournament or league.
g systematically retrieve data or content from the Services to create or compile, directly or
indirectly, a collection, compilation, database, or directory without written permission from
MaDiSt.
h circumvent, disable, or otherwise interfere with security-related features of the Services,
including features that prevent or restrict the use or copying of any content or enforce
limitations on the use of the Services and/or the content contained therein.
i use the Services in a manner inconsistent with any applicable laws or regulations.
j engage in unauthorized framing of our linking to the Services.
k upload or transmit (or attempt to upload or to transmit) viruses, trojan horses, or other
material, including excessive use of capital letters and spamming (continuous posting of
repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the
Services or modifies, impairs, disrupts, alters or interferes with the use, features, functions,
operation, or maintenance of the Services.
l attempt to impersonate another user or person or use the username of another user.
m upload or transmit (or attempt to do so) any material that acts as passive or active
information collection or transmission mechanism, including without limitation, clear
graphics interchange formats, 1x1 pixels, web bugs, cookies, or other similar devices
(sometimes referred to as “spyware” or “passive collection mechanisms”).
n attempt to bypass any measures of the Services designed to prevent or restrict access to the
Services, or any portion of the Services.
o copy or adapt the Services’ software, including but not limited to Flash, PHP, HTML, JavaScript,
or other code.
p except as permitted by applicable law, decipher, decompile, disassemble, or reverse
engineer any of the software comprising or in any way making up a part of the Services.
q except as may be the result of standard search engine or Internet browser usage, use, launch,
develop, or distribute any automated system, including without limitation, any spider, robot,
cheat utility, scraper, or offline reader that accesses the Services, or use or launch any
unauthorized script or other software.
4. Regardless of the above list of prohibited activities, the behavior of a CLIENT shall be
qualified as misconduct by MaDiSt - and thus considered a violation of the General T&Cs - if,
but not exclusively when, the CLIENT:
a tricks, defrauds, or misleads us and other users, especially in any attempt to learn sensitive
account information such as user passwords.
b disparages, tarnishes, or otherwise harms, in our opinion, us and/or the Services.
c uses any information obtained from the Services in order to harass, abuse, or harm another
person.
d makes improper use of our support services or submit false reports of abuse or misconduct.
e engages in any automated use of the system, such as using scripts to send comments or
messages, or using any data mining, robots, or similar data gathering and extraction tools.
f deletes the copyright or other proprietary rights notice from any content.
g interferes with, disrupts, or creates an undue burden on the Services or the networks or
other services connected to the Services.
h harasses, annoys, intimidates, or threatens any of our employees or agents engaged in
providing any portion of the Services.
i uses a buying agent or purchasing agent to make purchases on the Services.
j makes any unauthorized use of the Services, including collecting usernames and/or email
addresses of users by electronic or other means for the purpose of sending unsolicited email,
or creating user accounts by automated means or under false pretenses.
k uses the Services as part of any effort to compete with us or otherwise use the Services
and/or the content for any revenue-generating endeavor or commercial enterprise.
5. The CLIENT further agrees not to use any electronic communication features of the services
on the APP for any unlawful, tortious, abusive, intrusive, harassing, libelous, defamatory,
obscene, threatening, or hateful purposes, or any purpose that violates another person's
privacy.
6. In the event of the detection of prohibited activities or misconducts by a CLIENT, MaDiSt is
entitled to immediately terminate the Agreement with the CLIENT and exclude them from
further use of the APP. MaDiSt may also interrupt and terminate ongoing games, MadiSt may
temporarily (up to six months) or permanently block the CLIENT’s Account with or without
prior notice, and retain any funds or prizes derived from prohibited activities or misconduct
until the matter is clarified.
7. MaDiSt retains the right to determine, at all times, whether conduct falls within the
prohibited activities or misconducts referred to in this Section. Both of the lists of this Section
are not exhaustive.
6. Limited Use
1. MaDiSt grants the CLIENT a non-exclusive, non-transferable, and limited personal License to
access the APP. This License is conditioned on the CLIENT’s continued compliance with this
Agreement.
2. The CLIENT agrees not to resell any marketing materials provided by MaDiSt, nor to
permit unauthorized access to the APP by others. The CLIENT also agrees not to copy,
reproduce, or use any materials appearing on the APP for resale or any other purpose
without the prior written consent of MaDiSt.
3. The CLIENT shall be held responsible for, and bound by, any unauthorized use of the
APP that violates the terms outlined in sections 4, 5 and 6.
4. The CLIENT agrees to use the information received from MaDiSt's information
systems solely for the purpose of executing transactions within the APP.
5. The License granted under this Agreement will automatically terminate if MaDiSt
determines that any information provided by the CLIENT, including their email address, is no
longer current or accurate, or if the CLIENT fails to comply with any term or condition of this
Agreement. If MaDiSt establishes that the CLIENT has abused or violated any of its games or
services, the License will also terminate. Upon notification of such a violation, the CLIENT
agrees to cease accessing the services immediately.
6. MaDiSt reserves the right, at its sole discretion and with or without prior notice, to
terminate the CLIENT’s access to any or all services and remove or discard any information
or content provided through its services.
7. Account Cancellation
1. MaDiSt reserves the right, at its sole discretion, to refuse or cancel services and/or refuse to
distribute profits to any CLIENT for any legitimate reason, including but not limited to the following:
a) Any instance where MaDiSt has reason to believe that a person's activities on the APP may be
illegal;
b) Any instance where MaDiSt may suffer fiscal, regulatory, or pecuniary disadvantage due to a
CLIENT's activities;
c) Any instance where one or more transactions on the APP are determined by MaDiSt to have been
performed in violation of this Agreement.
2. MaDiSt strictly prohibits player collusion and takes active measures to prevent the
use of devices, such as robots or automated tools, that distort or interfere with normal
gameplay. Such conduct is considered a breach of this Agreement and will result in
immediate account cancellation.
3. MaDiSt reserves the right to terminate games without prior notice, alongside
accounts, especially in cases where irregularities, violations, or other suspicious activities or
misconducts are detected.
8. Registering & Playing games, Prizes
1. All available games are displayed on the main reference page for the specific game mode.
Free Players will only see free games for which no payment or prizes are available. Only Premium
PLAYERS will also see paid games for which there are prizes to be won.
2. For each individual game there is an information sheet summarizing the required number
of players to participate in the individual game, the number of players registered for the individual
game, the cost (if Premium Game) expected for entry, and the prize to be won (if Premium Game).
3. Access to Premium Games is exclusively reserved for persons over the age of 18 who have
a Premium Account (Premium Players).
4. When a PLAYER makes a final decision to participate in a particular game, tournament or
league, then that PLAYER is said to be registered for that game, tournament or league. The PLAYER
may register for any game up to 30 minutes before the start of the game. This condition applies to
any game mode, be it a single game, tournament or league, or be it Free or Premium (if Premium
Player).
5. 30 minutes before the start of the game, tournament or league, registrations are closed and
it is no longer possible to join. New registrations for any game are also blocked once the necessary
number of participating PLAYERS has been reached.
6. As a condition for participating in each Premium Game, the PLAYER is required to pay an
entrance fee (also known as a Ticket”) in advance. The cost of the Ticket is indicated during the
presentation of the individual game, tournament and league.
7. Regarding prizes, they will only be awarded to the individual who initially registered and
opened the account.
8. Only one account is allowed per person. No prizes will be awarded on accounts opened
under false names or multiple accounts opened by the same person.
9. Payments & In App Purchases
1. When the eligible PLAYER registers for any Premium Game, they pre-authorise the payment of
the entry fee via our payment system. MaDiSt does not withdraw any amount via the PLAYER's
payment card.
2. By means of pre-authorisation, the actual availability and suitability of the payment card used
by the PLAYER to make the payment of the requested ticket is verified.
3. When the game, tournament or league starts, the pre-authorisation takes effect and the pay-
ment is finalised; in this way, MaDiSt registers the PLAYER's participation in the
game.
4. If, by the 30 minutes deadline and for whatever reason, the necessary number of players is not
reached for a particular game, tournament or league to start regularly, then MaDiSt cancels the
pre-authorisations made by the PLAYERS already registered in that game.
5. In order to make payment of the admission ticket for a Premium Game, the Premium Player
may use one of the available payment methods, which are specified in Section 9 (Payments).
6. The CUSTOMER expressly authorises MaDiSt to collect the fees due pursuant to these T&Cs by
debiting the CLIENT's payment card.
7. To partially cover the fees incurred with our payment solution providers, MaDiSt reserves the
right to charge fees on certain payments. These fees are based on a cost sharing structure be-
tween MaDiSt and the User, which reflects the actual internal costs incurred.
8. MaDiSt reserves the right to impose certain conditions on the use of specific payment methods.
These conditions may be based on regulatory changes, changes from the payment provider, or
other factors, and may be enforced without prior notice.
9. MaDiSt does not guarantee that all payments methods will be always available.
10. MaDiSt may also provide for in-app purchases related to further functions (e.g. the possibility of
eliminating advertising on the APP), products or services. For all in-app purchases, MaDiSt pro-
vides the following payment channels:

Stripe: 1,5% (+ 0,20 GBP for each transaction)
10. Aborted or Miscarried Games & Errors
1. In the event of interrupted or failed play, all PLAYERS’ transactions are automatically
registered into MaDiSt’s log systems;
2. MaDiSt reserves the right to correct or declare results void in hindsight if the outcome of the
game was caused by a technical default or a fraudulent behavior by a Player. Additionally, MaDiSt
reserves the right to revoke any prize allocation made in error.
3. If any incorrect information is published on the APP, MaDiSt reserves the right, at its
absolute discretion, to correct such errors and take the necessary steps to ensure fair service
for its clients. Errors may include, but are not limited to, the following:
a) Incorrect setup of event details;
b) Wrong team, participant, or event details;
c) Incorrect deadlines;
d) Technical errors impacting game outcomes.
11. Limited Liability
1. The games and services offered on the APP are available to CLIENTS only within the scope
of the current technology used. MaDiSt provides no guarantee of the uninterrupted availability or
serviceability of the services offered. MaDiSt accepts no liability for any interruption in availability or
the serviceability of the games.
2. MaDiSt undertakes to provide steady services on the APP. However, MaDiSt assumes
no responsibility for any error, omission, interruption, deletion, defect, delay in operation or
transmission, communication line failure, theft, destruction, unauthorized access to, or
alteration of the APP or services.
3. MaDiSt is not responsible for any problems or technical malfunctions of any
telephone network or lines, computer online systems, servers or providers, hardware, or
software. MaDiSt is also not responsible for failures due to technical problems or traffic
congestion on the Internet or on any part of the APP or services.
4. MaDiSt accepts no liability for any interruptions in games or downtime. MaDiSt is not
responsible for errors in any game and is not obligated to correct them. Furthermore, MaDiSt
assumes no liability for the existence of viruses or other harmful components on the
corresponding servers, which could cause damage to the user's hardware of software.
5. MaDiSt is not liable for damages caused by mistakes in data entry, data storage, or
data processing, nor for any incompleteness or inaccuracy of transmitted data. MaDiSt
reserves the right to correct obvious mistakes during the storage and processing of results
(e.g. mistakes relating to the identity of the players, etc.).
6. To the maximum extent permitted by law, under no circumstances shall MaDiSt be
responsible for any loss or damage resulting from the use of the APP or services or from the
conduct of any users of the APP or services, whether online or offline.
7. In no event shall MaDiSt, its directors, or employees be liable to the CLIENT for any
damages whatsoever, including without limitation indirect, incidental, or consequential
damages, arising from or in connection with the CLIENT’s use of the APP, including but not
limited to the quality, accuracy, or utility of the information provided. MaDiSt is not liable for
damages of any kind caused by the undue use of the account by the PlLAYER or third parties.
8. MaDiSt is not liable for the loss of prizes caused by interrupted games.
9. In the event of an infringement of these General Terms & Conditions by the CLIENT,
the CLIENT agrees to indemnify MaDiSt against any claims by third parties and bear any
losses, costs, or damages resulting therefrom.
10. The foregoing limitation of liability shall apply to the fullest extent permitted by law
in the applicable jurisdiction. In no event shall MaDiSt’s cumulative liability to the CLIENT
exceed the amount of money the CLIENT pre-authorized in relation to the transaction giving
rise to such liability.
11. If you wish to participate in tournaments, leagues or games that require a ticket to
be paid (Premium Games) using the APP, you must pre-authorized the payment through our
payment services.
12. You are responsible for reporting your prizes and/or losses if such reporting is
required by your local tax laws or other authorities.
13. No provision shall be interpreted as creating or giving rise to any obligation on the
part of MaDiSt (or any other group company) to repay such funds to you as your debtor.
12. Intellectual Property
1. MaDiSt is the sole owner of all intellectual property rights in our Services, including
trademarks, service marks, trade names, logos, icons, source code, databases, functionality,
software, app designs, audio, video, text, photographs, and graphics in the Services (collectively, the
“Content”). The Content as a whole is protected by copyright laws, international treaties, and other
applicable provisions.
2. The CLIENT agrees not to delete, alter, or remove any copyright notices or other
indications of protected intellectual property rights from materials received from MaDiSt or
accessed on MaDiSt’s APP. The CLIENT does not obtain any intellectual property rights, nor
any right or license to use such materials or the APP, except as expressly set out in this
Agreement.
3. All images displayed on the APP are either the property of MaDiSt or are used with
permission. The CLIENT agrees not to upload, post, reproduce, or distribute any information,
software, or other material protected by copyright or other intellectual property rights,
including rights of publicity and privacy, without first obtaining the permission of the rights
owner and the prior written consent of MaDiSt.
4. The Content and all the marks are provided in or through the Services As is” for
CLIENTS’ personal and non-commercial use only.
13. Indemnification
1. The CLIENT agrees to defend, indemnify, and hold MaDiSt harmless, including our affiliates,
and all of our respective officers, directors, employees, agents and partners from and against any
loss, damage, liability, claim or debamdn, including reasonable attorneys’ fees and expenses, made
by any third party due to or arising out of:
1. The CLIENT’s access to or use of the APP or services;
2. The CLIENT’s violation of any terms of this Agreement;
3. The CLIENT’s breach of any applicable laws or regulations.
4. The CLIENT’s violation of the rights of a third party, including but not limited
to intellectual property rights.
14. Term & Termination
1. These Legal Terms shall remain in full force and effect indefinitely unless otherwise notified
by MaDiSt.
2. MaDiSt reserves the right to terminate this Agreement at any time by providing notice to the
CLIENT. Upon termination, the CLIENT will no longer be able to initiate new games. If updates to the
terms are implemented, the CLIENT will be asked to re-accept the terms. Failure to follow this
procedure will result in account termination.
3. The CLIENT may terminate this Agreement at any time by providing a 30-day written
notice to MaDiSt's customer support at info@madist.co.uk. Failure to provide this written
notice will result in the CLIENT remaining bound by all applicable terms and conditions.
15. Marketing & Promotion
1. MaDiSt’s marketing and promotional materials comply with UK GDPR, ensuring they are
clear, not misleading, and respectful of customers’ consent.
2. MaDiSt may request the winners of specific tournaments or leagues to grant
permission for the publication of their Teamname, name and/or portrait in all media as part
of the company’s marketing and promotional effort on the APP. PLAYERS may deny, limit, or
withdraw their consent at any time. In the specific case where a PLAYER gives consent for
publication and later wishes to withdraw it, MaDiSt will ensure the deletion of any
information that could identify the PLAYER within the time frames established by law or
applicable regulations.
3. For the avoidance of doubt, MaDiSt shall request publication permission only from
Premium Players.
16. Privacy
1. By opening an account with MaDiSt and upgrading to the Premium Account, the PLAYER
implicitly grants authorization for the processing of personal data in compliance with the EU, UK,
and other applicable laws. The processing of personal data is exclusively conducted for the purpose
of account maintenance and the provision of services offered by MaDiSt. MaDiSt is committed to
processing and protecting your personal data in accordance with applicable data protection laws.
MaDiSt ensures the privacy, confidentiality, and security of its CLIENTS' personal information, during
and after their interactions with the company, to the fullest extent possible.
2. When CLIENTS register with MaDiSt to participate in Premium Games, they agree to
provide personal information that will be used to confirm the CLIENT's identity and secure
their deposits and player account. This information is collected as part of stringent
verification procedures designed to ensure the security of CLIENT activities. Only authorized
personnel will process and access this data.
3. CLIENTS are responsible for providing true, updated, and accurate information
regarding their identity. They confirm they are registering on their own behalf and are not
acting in any way that could be considered fraudulent or as impersonating another individual.
4. MaDiSt's data collection procedures include gathering information freely provided
by the CLIENT, as well as using cookies to collect data on how CLIENTS interact with the APP.
These tools are used to enhance CLIENT security. All data collected by MaDiSt is shared only
with personnel responsible for verifying CLIENT account information to ensure
confidentiality and security.
5. MaDiSt will never disclose private or confidential information regarding its CLIENTS
to third parties without the express, written consent of the CLIENT, except where required by
law or necessary for identity verification or account security purposes.
6. By registering with MaDiSt and engaging with its products and/or services, CLIENTS
consent to the use of their information for account management and transactions. All
interactions between the CLIENT and MaDiSt will be stored for record-keeping purposes and
may be used by MaDiSt in case of disputes.
7. MaDiSt is committed to ensuring the confidentiality of CLIENTS' personal
information by implementing robust data protection procedures. These procedures are
regularly updated to continually safeguard CLIENT data.
8. From time to time, MaDiSt may contact CLIENTS via email to provide further
information about MaDiSt products or services. MaDiSt may also inform CLIENTS of unique
promotional offers. By consenting to these terms during registration, CLIENTS agree to
receive such communications. Those wishing to opt out of further contact can do so by
contacting customer support.
9. Any suspicious or fraudulent activity will be reported to the appropriate authorities
without delay.
10. Player data and documents will be retained by MaDiSt for a minimum of 5 years after
the business relationship has ended or after the date of the last transaction, in accordance
with legal and regulatory requirements. Data and documents older than 3 years will be
archived. A user who has closed their account may contact support to request that their
account be anonymized and personal details removed, subject to retention requirements.
However, personal data related to financial transactions will be retained for a minimum of 5
years after the end of the business relationship or the last transaction and may be retained
for an additional period if required by law or competent authorities. No retention guarantee
is provided for insignificant data such as interim results or unplayed lineups, unless such
data is linked to financial transactions or regulatory compliance, in which case it will be
retained for at least 5 years.
